Goof-up wake-up call for agencies: Chidambaram

Terror listHome MinistryChidambaram

New Delhi: Home Minister P Chidambaram on Saturday said the "embarrassing" goof-up in the 'most wanted fugitives list' given to Pakistan is a wake up call to security agencies to become more professional but ruled out giving any apology for the lapse.

He also said that the goof-up does not damage government's credibility and it will "not change the dynamics" of Indo-Pak relationship or the status of discussions between them.

Chidambaram also dismissed suggestions that after this blunder, Pakistan will grow dismissive about India's repeated requests to handover terror suspects sheltered in that country.

"I don't think it damages credibility. I think it is a wake up call for the agencies to become more professional," he said to Karan Thapar on 'Devil's Advocate' programme on a private news channel.

He was asked whether he would accept that the goof-up damaged the governments credibility even in a small part if not in a big way.

Chidambaram was asked whether the government owed an apology to the two persons named in the fugitives list as hiding in Pakistan but were actually living in India.

"I don't think this is a case we owe an apology to anyone. We expressed regret that there was a genuine human error in not updating the list. To that extent, we have expressed regret and we remain regretful. But I think we have carried the argument too far," he said.

He said the two (named in the list living in India) were fugitives of justice. Red Corner Notices were indeed issued to them. Subsequently they were arrested.

Chidambaram said it is not right to exonerate them at this stage.

"They are accused in grave charges. The mistake was not removing their names from the Red Corner Noticees list and consequently the mistake of by including them in the list handed over by the Home Secretary. I think you are carrying too far by saying that the two are innocent people."
Asked about the implications of the goof-up in the eyes of Pakistan and whether they would be dismissive of the Indian list he said, "I doubt it. See, these lists were exchanged in 2004, in 2007, in 2011. Pakistan has always been dismissive whenever we gave the list in 2004, 2007. They never acted on any list.

To a question whether the mistake would change the dynamics of Indo-Pak relations, he said, "it is embarrassing, but it will not change the dynamics of the the relationship between India and Pakistan or status of discussions because Pakistan has always been dismissive of these lists".

Chidambaram pointed out that soon after the lapse became public he had returned from a trip from Tripura and was "the first to immediately call the press and say we take responsibility".

"Since the list was handed over formally by the Home Secretary, we have taken, what I would call, constructive responsibility," he added.

To a question on criticism that people say it is "incompetence" on the part of the government as a whole and not just the Home Ministry, he said "well, thats a very harsh word. It's a mistake or two mistakes...now if you want to raise it to the level of incompetence, that's your call."

NCW for CBI probe into Gr Noida violence

Updated on Saturday, May 21, 2011, 15:35

New Delhi: Backing Rahul Gandhi's claim of police atrocities on farmers in Greater Noida villages, the NCW on Saturday said complaints of molestation, stripping and rape of women as well as of people being burnt alive have come before it and sought a CBI probe to "bring out the truth".

National Commission for Women acting chairperson Yasmeen Abrar, who led a fact-finding team that toured affected Bhatta and Parsaul villages, said they will submit a preliminary report to Prime Minister Manmohan Singh.

"We have formed a 11-member team headed by me and comprising retired judges and civil society activists which will visit the villages again on Monday and Tuesday, carry out further probe and collect evidence," she told reporters here.

The NCW chief, while maintaining that policemen committed "atrocities" on women after the police-farmers clash over a protest on land acquisition issue, said the villagers stopped short of using the word "rape" but indicated towards that.

"Some women alleged that they were raped, but being from a conservative village, they did say it in their own way. They said give the policemen the punishment meted out to rapists. They said policemen barged into their homes, molested them and torn off their clothes...some of them said they did something more than that. What do you make of that," she said.

"One woman said 12-15 policemen surrounded her and assaulted her, tearing off her clothes," she said.

Abrar said 15-20 women gave depositions with their signs or thumb impressions detailing "atrocities" but maintained that till now these are only charges and a CBI probe should be launched "as soon as possible" to "bring out the truth".

"We ask why no FIR was lodged by Uttar Pradesh against local officials? There should a free and fair probe which only CBI can conduct and culprits punished without delay.

I have heard evidence are being destroyed," Abrar said.

She said the women showed them burnt homes and haystacks and alleged that people were burnt and tossed there. "One woman said several men were shot and dumped in the mounds."

Asked whether she saw any bones among the burnt mounds, she said "there was something". To a question if the team collected samples of bones from the site, Abrar said "we will not share all the evidence we got with the media."

When it was pointed out that the UP government said preliminary forensic reports of ashes collected from the area have ruled out presence of human remains, she said, "they did the test in their own labs and we are not satisfied with it."

Asked if she was backing Congress leader Rahul Gandhi who also levelled allegations of rape and torching of people, she said "don't bring any political party into this."

However, she launched a full-scale attack on Chief Minister Mayawati saying she should have visited the area and understood the "pains of women there". UP tops in complaints of rape and gangrape coming to the women's panel, she said.

She demanded food and security for the villagers. "Most men are yet to come back to the villages and women feel insecure. There should be lady constables," she said.

Kanimozhi spends the night in jail, to be back in court today

Zeenews Bureau

New Delhi: DMK MP MK Kanimozhi, the daughter of former Tamil Nadu chief minister M Karunanidhi, spent a quiet night in Tihar Jail’s prison number 6 after being arrested in the 2G scam case.

A special CBI court had on Friday refused to grant bail to Kanimozhi and Kalaignar TV managing director Sharad Kumar citing the ‘magnitude of the crime’.

Jail officials said no five-star treatment was given to both Kanimozhi and Kumar.
While Kanimozhi was lodged in Jail No 6, Kumar was sent to Jail No 4 which also has Commonwealth Games scam accused Suresh Kalmadi.

Madhuri Gupta, former official at Indian High Commission in Islamabad who was arrested on charges of spying, pimp Sonu Punjaban and MCD councilor Sharda Jain are Kanimozhi’s immediate neighbours at Tihar.

Both Kanimozhi and Kumar will be back in the CBI court today as the case comes up for hearing.

Addressing a packed courtroom at the Patiala House premises, CBI Special Judge OP Saini had yesterday said: “Considering the magnitude of the crime, nature and enormity of the allegation, character of evidence on record and the apprehension that the witnesses may be influenced in case the accused are released on bail, I have no hesitation in holding that both accused have failed to make out prima facie case for bail.”

Kanimozhi, 43, who was accompanied in court by her husband Aravindan, tried to regain her composure after the judgment was pronounced and later told her supporters, “I was expecting the decision.”

There was shock as the ruling was read out. Her colleagues in the DMK and security guards held each other tearfully as she was taken into the lock-up in the Patiala House court premises.

Co-accused — and former communications minister — A Raja also looked stunned. The DMK MP is already in jail in connection with the case, related to irregularities in the allocation of airwaves to telecom companies that caused huge losses to the exchequer. Fourteen people, including several corporate leaders, have been charged in the case.

The court had allowed Kanimozhi to carry her medicines, books and reading glasses to Tihar Jail. It even allowed her home food and a cell with an attached bathroom, but declined her plea to continue wearing her nose pin while in jail.

RN Sharma, Deputy Inspector General, Prisons, had said there would no VIP treatment for Kanimozhi, who is used to comforts of high life.

“She has been given a separate cell with attached toilet, the cell has television, fans and light. As far as food is concerned she can have South Indian food. This is not a special allowance as such because we give many other jail inmates South Indian food like idli, vada and sambar,” Sharma said.

The CBI had named Kanimozhi and Sharad Kumar as co-conspirators in its April 25 supplementary chargesheet after it traced an illegal money trail of Rs 214 crore in the scam.

The court verdict, exactly a week after the DMK was routed in the Tamil Nadu polls, could not have come at a worse time.

Many political analysts said this is a ‘litmus test’ for the party.

The DMK, amid fresh strains with its key ally Congress, is holding a crucial meeting in Chennai today to chalk out its plan for the future.

The DMK top brass is expected to discuss ways to handle the new situation arising out of CBI naming Kanimozhi as co-conspirator in the scam, taking it to the doors of DMK's first family for the first time.

RAJIV GANDHI REMEMBERED ; BORN ON 20 AUGUST 1944 DIED ON 21 MAY 1991

By Shafee Ahmed Ko
May 21, year after year is a solemn occasion to reminisce that the 9th Prime Minister of independent India, Rajiv Gandhi was assassinated by the Sri Lankan Thenmuli Rajaratnam alias Dhanu, a human bomber of the Liberation Tigers of Tamil Eelam (LTTE) at Siriperumbudur near Chennai,Tamil Nadu.
Velupillai Prabhakaran, the leader of LTTE, and his intelligence Chief Pottu Amman, conspired and hatched the evil plot and brought a pall gloom in the country by killing the soft leader.

It was so horrendous, and shockingly dreadful to lose a Prime Minister Rajiv Gandhi, a personality marked by seriousness and earnestness. His avant-garde and fine contribution, especially bringing in a computer era is note worthy and millions of young Indians have been benefited.
The role played by Ms.Jayalalithaa to trace the culprits such as Sivarasan, and many others with an iron fist, similar to a Pied Piper-like attitude is quite commendable.
Rajive Gandhi was born on August 20,1944,and died on May 21 1991,at the age of 46.He was the Prime Minister of India in office from 31 October 1984- 2 December 1989.
Rajiv Gandhi was the elder son of Indira and Feroze Gandhi. He was educated at Cambridge, where he met Italian-born Sonia Maino, whom he later married. After Cambridge, he became a professional pilot for Indian Airlines. He remained aloof from politics despite his family's political prominence. Mamata takes oath as West Bengal CM

Kolkata

Trinamool Congress (TMC) chief Mamata Banerjee and her new Council of Ministers were sworn-in today at Raj Bhavan at 1:01 p.m. Governor M.K. Narayanan administered the oath of office and secrecy.

Besides Banerjee, 42 Ministers also took oath at the glittering function.

Out of total ministers, 35 will be from Trinamool Congress and remaining seven from Congress.

Over 3,200 guests including outgoing Chief Minister Buddhadeb Bhattacharjee, Chief of Tata Group Ratan Tata, family members of Shingur and Nandigram movement victims were invited to witness the star-studded swearing-in ceremony.

Also present were Union Ministers P. Chidambaram, A. K. Anthony and Pranab Mukherjee.

Giant screens were set up at various locations in Kolkata for live telecast of the ceremony for everyone to see.

The Trinamool Congress, had on Monday, formally staked the claim to form the next government in West Bengal shortly after Banerjee was unanimously elected Leader of the Trinamool Congress Legislature Party (TCLP).

The TMC-Congress combine won 227 seats out of 294 in the legislative assembly, while the ruling Left Front, led by the Communist Party of India-Marxist (CPI-M), only garnered 62 seats.

The TMC is the biggest coalition ally of Congress and holds the balance of power in Parliament. Analysis feel that her victory may force the government to be more dependent on an unpredictable parliamentary partner opposed to several key economic reforms.

DMK MP Kanimozhi arrested, sent to Tihar jail

New Delhi, May 20 (PTI)

Kanimozhi, DMK MP and Karunanidhi's daughter, was today arrested and sent to Tihar jail by a Delhi court which dismissed her bail plea in the 2G spectrum scam, saying there was a possibility of witnesses being influenced considering the "magnitude" of the crime.

T
he 43-year-old daughter of Karunanidhi's second wife Rajathi, was shocked on hearing the order pronounced by Special CBI judge O P Saini but maintained her calm in the court.

However, tears welled up in her eyes when she was taken to the court lock-up by police personnel.

Clad in an orange salwar suit, she was later driven in a Delhi police van to Tihar prison where she will be lodged in jail no 6. Former Telecom Minister A Raja is already lodged in Tihar.

The judge also rejected the bail plea of Sharad Kumar, MD and CEO of Kalaignar TV Private Ltd, who along with Kanimozhi, faces the charge of conspiracy and bribery in accepting Rs.200 crore from D B Realty for for the channel in the spectrum scam.
"Considering the magnitude of the crime, nature and enormity of the allegations, character of evidence on record and the apprehension that the witnesses may be influenced in case the accused are released on bail, I have no hesitation in holding that both applicants/accused have failed to make out a prima facie case for bail.

"Bail applications are without merit and the same are dismissed," the court said in its 144-page order brushing aside her lawyer Ram Jethamalani's arguments that urged for chivalry for her being a woman.

One of the bodyguards of Kanimozhi started crying inconsolably when Kanimozhi was being taken inside the lock-up at Patiala House Courts here.
Kanimozhi, who was  accompanied by her husband Aravindan, family members and DMK Parliamentary Party chief leader T R Baalu, first inquired about the order from A Raja as she could not hear it properly.

As Raja broke the news to her, stunned Kanimozhi tried very hard to control emotions and was being hugged by her husband before some women constables took over and led her inside the lock-up.

The court  said most of the witnesses against the DMK MP are the employees of Kalaignar TV and hence, possibility of they being influenced cannot be ruled out.
"Considering the magnitude of the crime and the fact that many of the witnesses are employees of Kalaignar TV, there is every apprehension that the witnesses may be influenced, if the accused are released on bail," it said.

The court, which did not not go into the merits of the case and termed the observations as "tentative", said that there were "incriminating" evidence against her and Sharad.
"The role of both of the accused in the case is clear... magnitude of the crime is enormous. The allegations, on the face of it, are very grave.

"The supporting evidence is also there on record. The submissions, as such, with utmost respect are without merit," the court said.

The court, which had reserved its order on May 7, on the bail applications of Kanimozhi and Sharad Kumar has referred to various judgments of the Supreme Court to negate the arguments of noted criminal lawyer Ram Jethmalani who appeared for the DMK leader.

The court rejected the legal argument that an accused be released on bail if she was not arrested during investigations.

"It is clear that on the appearance of an accused in court in response to summons issued by the court, his bail application is required to be disposed of on merits of the case and bail cannot be allowed as matter of right.

"As such the accused has no right to be released on bail simply because she was not arrested during investigation and appeared in the court in response to the summons.
He has to make out a case for bail on merits," it said while referring to various case laws on the issue.

Giving reasons for denial of bail, the court said some of the key witnesses against them were the employees of Kalaignar TV, alleged recipient of Rs 200 crore bribe from firms promoted by Shahid Usman Balwa and they can be influenced upon.
The court also cited the statements of prosecution witnesses G Rajendran, an employee of Kalaignar TV and Aseervatham Achary, a former aide of Raja,  to refer to the culpability of Kanimozhi and Sharad Kumar in the 2G scam.

The judge said that  both the accused were in conspiracy with each other and A Raja. They played key roles in receiving illegal gratification for their television channel in which both held 20 per cent shares each.

The court also rejected the plea of Jethmalani that Kanimozhi be released on the sole ground that she is a woman. "Sex is one of the grounds which may be considered at the time of grant of bail. However, considering the magnitude of the crime and the allegations against her, I am unable to show any consideration to her on this ground," the court said.

However, the "dignified" conduct of Kanimozhi during court proceedings earned special praise for her. "I wish, I could show her some consideration, considering her extremely dignified conduct in the court," the CBI Judge said.

CBI had chargesheeted Kanimozhi on April 25 in the scam. It had indicted her of having taken bribe to the tune of Rs 200 crore, which was routed to Kalaignar TV, in which she has 20 percent stake.

Besides Kanimozhi, former Tamil Nadu Chief Minister Karunanidhi's wife Dayalu Ammal, holds 60 per cent share in the Kalaignar TV. She, however, was not chargesheeted in the case as the CBI said she neither knew English nor used to take part in the day-to-day functioning of the channel.

Opposition welcomes DMK MP Kanimozhi's arrest

New Delhi: The Opposition on Friday welcomed the CBI special court's decision ordering the arrest of DMK MP Kanimozhi in the 2G scam spectrum case.

"These arrests and actions have been possible only because the Supreme Court is monitoring the inquiry," said BJP spokesperson Prakash Javadekar.

He also added, "This is the only UPA regime where government controlled inquiries will produce no results."
Javadekar said, "If we want effective results, the only way is Supreme Court because government monitored agencies do not perform. The enquiries about other scams including CWG then only will we be getting justice."

Communist Party of India (CPI) Secretary D Raja said, "Congress stands thoroughly exposed."

Kanimozhi and Kalaignar TV MD and CEO Sharad Kumar were arrested after a Special Central Bureau of Investigating (CBI) court dismissed the bail petition of Kanimozhi and Sharad Kumar in the case following which they were taken into custody.

While rejecting their bail petition Judge OP Saini ordered their "forthwith" arrest and directed the duo to appear before it at 10 am on Saturday. Kanimozhi and Kumar will be lodged in Delhi's Tihar jail.

DMK leaders take stock of Kanimozhi's bail plea rejection

Chennai: Top DMK leaders went into a huddle at the residence of party chief M Karunanidhi in the wake of a Delhi court rejecting the bail plea of his daughter Kanimozhi in the 2G spectrum case on Friday.
Senior leaders rushed to the CIT Colony residence of Karunanidhi and Kanimozhi soon after news broke out about the court verdict.
Karunanidhi was glued to the TV to know about the latest on the fate of his daughter, set to be arrested by CBI, and was "apparently" upset after the rejection of the bail plea, party sources said.
The next course of action of the DMK, a key ally of UPA, was not immediately known.
Putting up a strong defence of Kanimozhi when she was named in the charge sheet as a co-conspirator along with former telecom minister A Raja, the DMK had said it would fight the case legally.

AIADMK vote share not sufficient to best its 1991 record

T. RAMAKRISHNAN

The AIADMK's return to power in the Assembly elections, despite being spectacular, was not sufficient to best its 1991 record in securing vote share.
At that time, the party, along with the Congress, faced the elections and contested from 168 constituencies, three more than in 2011. Its vote share then was 44.39 per cent whereas the party has bagged 38.41 per cent of the total votes polled now. The 1991 elections were marred by the assassination of Rajiv Gandhi in Sriperumbudur on May 21, 1991.
But, what was more significant was that, as has happened now, it was Jayalalithaa who had then spearheaded the poll campaign for her front as general secretary of the All India Anna Dravida Munnetra Kazhagam (AIADMK). She became Chief Minister for the first time then.
The 2011 performance was marginally less than what the party had achieved in 1980 when its founder M.G. Ramachandran made a spectacular comeback after the dismissal of his ministry in February that year. Fighting the elections with a number of smaller parties, the AIADMK, 31 years ago, won 129 seats and polled 38.75 per cent.
If one were to exclude the performance of the AIADMK in 1989, when it was a divided house and two groups faced the elections separately on two different symbols, the party got the lowest vote share, 21.47 per cent, in 1996. At that time, the AIADMK was trounced and Ms. Jayalalithaa herself lost from Bargur constituency. It won in just four constituencies.
An interesting feature of the performance of the AIADMK over the years was that it secured only 30.36 per cent of votes in the 1977 elections, described by many as historic, given the fact that the party captured power for the first time. On all other occasions, except in 1991, the party had polled higher vote share. Even in 2006, when the party lost power, it got 32.64 per cent.

PROF JAWAHIRULLAH TAKES MODI’s PRESENCE A BAD TASTE

By Shafee Ahmed Ko

While Actor-turned politician Jayalalithaa was sworn-in as the Chief Minister of Tamil Nadu for the third time, on 16 Monday,as she is fondly known as “Amma” (Mother) took oath along with 33 other cabinet colleagues.

The 63-year-old leader, “Amma” was sworn in at the historic Madras University's centenary auditorium at 12.15 noon, where
the Gujarat Chief Minister Narendra Modi,(notorious in Gujarat riot 2002) former Andhra Pradesh Chief Minister N Chandrababu Naidu and CPI general secretary A B Bardhan and few others were also present.

The presence of Modi, a man with anti secular image who became a
wholesome of nothing morllay,  but naturally an irksome to not only section of minorities, no wonder but an extent that a Visa to his USA trip denied in a stinging stub when Modi was to pay a five-day visit to the US from March 20, 2005.(The Act prohibits anybody who was 'responsible for, or directly carried out, at any time, particularly severe violations of religious freedom' from entering the US).

The staunch  leader such as Prof.M.H.Jawahirullah,leader of Manitha Neya Makkal Katchi (MNMK) naturally will grow in anguish for such humiliations while Modi orchestrated killings of thousands of Muslims as strong reports support the carnage, and butchery.

Further the statement of Narendra Modi’s covert speeches are clear in tone that in the National Polity there shall  have non secular governance. The message which appeared in the renowned National print media, “The Hindu” May 17 is sufficient ground for such an advance ploy:

“Talking to journalists at a hotel in the city, he said the one positive thing emerging out of these elections was the shaping of bipolar politics in the country. “While there is a camp of politicians solely interested in vote bank politics, there is also one that has development as its prime agenda, and committed to it. This programme will strengthen that kind of developmental politics,” he said. Politically, Mr. Modi believed that Ms. Jayalalithaa's win would have an impact on the national political scenario”

We also find a similar suitable token of plans of non secular mindset for the mainstream fabric of India. A website, “deshgujarat.com” reads as follows:
In her recent statement during conversation with a TV channel Jayalalitha had said the nation needs a strong Prime minister not only to run the country but also to protect it. Many believe that she was hinting Narendra Modi without naming him.
